General conditions of sale

Scope and duration of the conditions

  1. The Terms and Conditions of Sale apply to the purchase of goods and services from the online store (perfect leotards OÜ) www.policrystals.eu between the buyer (hereinafter referred to as the Consumer) and policrystals.eu.
  2. In addition to these terms and conditions, legal relations arising from the purchase of products from the policrystals.eu online store are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
  3. policrystals.eu reserves the right to make changes to the conditions of sale. This modification will be used on the website www.policrystals.eu.

About prices

  1. Prices are valid from the time the order is placed until the payment deadline for the placed order expires (24 hours after the order is placed).
  2. If the order is placed before the terms and conditions of sale or the prices have been changed, the legal relationship between the Consumer and www.policrystals.eu shall be governed by the terms and conditions in force at the time the order was placed.
  3. www.policrystals.eu reserves the right to make changes to its sales prices. This change will be used on the www.policrystals.eu website.

Placing an order

  1. Add the products you want to your shopping cart.
  2. To place an order, click on the “Place order” link in the shopping cart.
  3. On the order form, fill in the required fields, select the delivery method and payment method that suits you and click on the “Confirm order” link. You will then be redirected to the bank to pay the invoice. If you choose to pay by bank transfer, an invoice will appear on the screen, which you can pay by euro cash at the bank of your choice. The details of the euro payment, including all applicable national taxes and surcharges, can be found on the invoice displayed on the screen after you have confirmed your order.
  4. Please fill in the fields on the details and order confirmation page carefully, as the accuracy and correctness of the information provided will determine the prompt and smooth delivery of the products you have purchased and the subsequent resolution of any disputes and claims.
  5. Orders placed in the www.policrystals.eu online shop are processed on weekdays Mon-Fri 10:00-18:00.
  6. Payments are processed by Visa, Mastercard.

Entry into force of the sales contract

  1. By the contract for the sale of the Goods, www.policrystals.eu undertakes to deliver to the Consumer the Goods existing, to be manufactured or to be acquired by www.policrystals.eu in the future, and to enable the transfer of ownership to the Consumer, while the Consumer undertakes to pay www.policrystals.eu the amount indicated on the invoice for the Goods and to take delivery of the Goods.
  2. Orders for which payment has not been received will be cancelled within 72 hours of the order being placed, unless payment on the spot is selected.
  3. The sales contract will enter into force after the payment made by the Consumer has been credited to the bank account of www.policrystals.eu.

    Find your nearest Omniva parcel machine! Delivery within 3 working days of purchase (except for products with a longer delivery time). Once the parcel is delivered, you will receive an SMS containing a security code to open the parcel machine. Keep the parcel and the SMS as you may need it later in case you need to return something to us.

  2. www.policrystals.eu will not be liable for any delay in the delivery of the goods if the goods have been delivered to the logistics partners on time, but the delay in delivery is due to circumstances beyond www.policrystals.eu’s control or foreseeable.

Right of return

  1. The consumer’s right of return is provided for by law and is not specific to ordering from the www.policrystals.eu online shop.
  2. After receipt of the order, the Consumer has the right to withdraw from the contract concluded in the e-shop without giving any reason within 14 days. Pursuant to section 53(4) of the LOA, the Consumer does not have the right to withdraw from a contract in respect of goods that cannot be returned due to their nature.
  3. You have the right to cancel the order and return the products if the products are unused and undamaged, including in their original packaging and stored and transported under the conditions specified on the invoice label. 
  4. In order to return the Goods, the Consumer must submit a free-form withdrawal request to perfect.leotards@gmail.com no later than 14 days after receipt of the Goods.
  5. The consumer must either return the goods within 14 days of the date of the application or provide proof that he/she has handed over the goods to the logistics company within the aforementioned period.
  6. The consumer does not have to return the goods via a logistics company if www.policrystals.eu has agreed to collect the goods itself.
  7. www.policrystals.eu shall, upon receipt of the notice of withdrawal, refund to the consumer without undue delay, but no later than 14 days after receipt of the notice of withdrawal, all charges received from the consumer under the contract, including the cost of delivery of the item used by the consumer, unless the consumer has expressly chosen a method of delivery other than the cheapest method of delivery offered by the trader, www.policrystals.eu is not obliged to refund to the consumer the cost of delivery exceeding the cost of the usual method of delivery.

Unquantifiable force

  1. www.policrystals.eu shall not be liable for any loss or damage caused to the Consumer or any delay in delivery of the goods if the loss or damage or delay in delivery of the goods is due to circumstances beyond www.policrystals.eu’s control or foreseeable.

Privacy policy

  1. The personal data of the client is processed in accordance with the Personal Data Protection Act.
  2. www.policrystals.eu collects the Consumer’s personal data when creating a customer account and/or placing an order.
  3. The personal data processed are the Consumer’s name, e-mail address, mobile phone number and preferences.
  4. www.policrystals.eu uses personal data to provide, develop and personalise services to Consumers. These services are in particular to be understood as the sale of goods to Consumers and the organisation of personalised offers on the www.policrystals.eu website.
  5. By entering data in the online shop and with the corresponding confirmation, the Consumer grants the right to collect and process the Consumer’s personal data and to forward the data necessary for the delivery of the goods to the logistics partner.
  6. www.policrystals.eu has the right to use the Consumer’s home or business address for advertising and other information to the Consumer.
  7. The consumer has the right at any time to object to the collection and use of his personal data, unless this is necessary for the recovery of a claim arising from the contract or for the delivery of the goods. Consent to the use of personal data cannot be withdrawn retroactively.
  8. The use of electronic personal data for direct mail will only take place if the Consumer has given his/her consent on the website www.policrystals.eu.
  9. Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank identifiers, which are not accessible by www.policrystals.eu.
  10. www.policrystals.eu company is the controller of personal data and transmits the personal data necessary to process payments to the processor Montonio (Visa, Mastercard).
  11. www.policrystals.eu does not disclose any personal information about the Client to third parties..

     

Complaints procedure

  1. The repair or replacement of defective Goods will be agreed between www.policrystals.eu and the Consumer. The cost of repair shall be borne by www.policrystals.eu.
  2. www.policrystals.eu shall not be liable for any defects in the Product caused by the Consumer as a result of improper storage or use of the Product for any purpose other than that for which it was intended.
  3. In the event of non-conformity or defects in the product, please send a complaint to perfect.leotards@gmail.com, stating the name of the person placing the order, the contact telephone number, the order number and a precise description of the non-conformity or defect.
  4. Complaints concerning non-compliance or defects must be lodged within two months of the date of discovery of the non-compliance or defect.
  5. All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than 14 days after receipt of the complaint.
  6. The consumer has the right to demand that www.policrystals.eu reduce the purchase price or terminate the contract and claim a refund if www.policrystals.eu is unable to repair or replace the goods, the repair or replacement fails, www.policrystals.eu has not remedied the defect within a reasonable time, or the consumer has suffered unreasonable inconvenience.

Consumer’s right to apply to the Consumer Complaints Commission

  1. If www.policrystals.eu has refused to resolve a Consumer’s complaint or if the Consumer disagrees with the solution offered by www.policrystals.eu and considers that his/her rights have been violated or his/her interests have been harmed, the Consumer may lodge a complaint with the Consumer Complaints Commission through the Consumer Protection Board or with the courts. The consumer may lodge a complaint himself or through a representative. The details of the Consumer Complaints Commission can be found on the website of the Office, Consumer Agency
